The www.wiremad.co.uk website (hereafter 'Our Website') is maintained by Warrington Town Supporters Club (hereafter 'The Club') for the use of customers and non-customers (hereafter 'User' or 'Users').

These Terms of Use tell Users the terms and conditions relating to their use of Our Website. Users should read these Terms of Use carefully before using Our Website.

By using Our Website, Users indicate that they accept these Terms of Use and agree to abide by them from the date of first use. If Users do not agree to these Terms of Use then they should refrain from using Our Website.

1 Accessing Our Website

1.1 Access to Our Website is permitted on a temporary basis. The Club reserves the right to withdraw or amend the services povided by The Club on Our Website at any time without notice.

1.2 From time to time The Club may restrict access to some parts or all of Our Website to Users who have registered with Our Website.

1.3 If Users are provided with a user name, password or any other piece of information as part of The Club's security procedures, Users must treat such information as confidential and must not disclose it to any third party. The Club has the right to disable any user name or password, whether chosen by the User or allocated by The Club, at any time, if in the opinion of The Club the User has failed to comply with any of the provisions of these Terms of Use.

2 Liability

2.1 The Club shall not be responsible for any errors or omissions contained in any part of Our Website. Any of the material on Our Website may be out of date at any given time and The Club is under no obligation to update such material. If the need arises, The Club may suspend access to Our Website or close it indefinitely. The Club will not be liable if for any reason Our Website is unavailable at any time or for any period.

2.2 The Club can accept no liability for the accuracy of or the content of material on any part of Our Website, nor the content of any third party website to which Our Website is linked.

2.3 The information contained on Our Website is for general guidance only. Users should neither act nor refrain from action on the basis of any such information. The Club disclaims all responsibility (including in negligence) for all consequences of any User acting on or refraining from acting in reliance on information contained in any part of Our Website.

2.4 To the extent permitted by law and except where stated within Our Website, The Club hereby excludes all warranties, express or implied and shall have no liability for any loss, either direct, indirect, loss of profits or other economic loss whatsoever and howsoever arising as a result of Users accessing Our Website or any third party website to which it is linked.


3 Information about Users

3.1 The Club processes information about Users in accordance with its Privacy Policy.

3.2 By using Our Website, Users consent to such processing and warrant that all data they provide is accurate.


4 Age Restriction

4.1 Users must be 14 years or older to register with Our Website.

4.2 If a User is under age 14 then the User should ask their parent or guardian to register with Our Website on the User's behalf.


5 Content Standards

5.1 These content standards apply to any and all web pages and files that the User uploads to the Club's servers (herein referred to as the "Material"), and to any interactive services associated with it.

5.2 The User must comply with the spirit of the following standards as well as the letter. The standards apply to each part of any Material as well as to its whole.

5.3 Material must:

5.3.1 be accurate (where they state facts);

5.3.2 be genuinely held (where they state opinions); and

5.3.3 comply with applicable law in the UK and in any country from which they are posted.

5.4 Material must not:

5.4.1 contain any material which is defamatory of any person;

5.4.2 contain any material which is obscene, offensive, hateful or inflammatory;

5.4.3 contain any material that is pornographic or content perceived to be pornographic or links to pornographic content;

5.4.4 contain ay material that is child pornography or content perceived to be child pornography or links to child pornography;

5.4.5 promote violence;

5.4.6 promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;

5.4.7 infringe any copyright, database right or trade mark of any other person, including but not limited to unauthorized copying of music, books, photographs, or any other copyrighted work;

5.4.8 be likely to deceive any person;

5.4.9 be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence;

5.4.10 promote any illegal activity;

5.4.11 be threatening, abuse or invade another's privacy, or cause annoyance, inconvenience or needless anxiety;

5.4.12 be likely to harass, upset, embarrass, alarm or annoy any other person;

5.4.13 be used to impersonate any person, or to misrepresent your identity or affiliation with any person;

5.4.14 give the impression that they emanate from The Club, if this is not the case; or

5.4.15 advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.


6 Viruses, hacking and other offences

6.1 Users must not misuse Our Website by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. Users must not attempt to gain unauthorised access to Our Website, the server on which Our Website is stored or any server, computer or database connected to Our Website or used by The Club to provide services. Users must not attack Our Website via a denial-of-service attack or a distributed denial-of-service attack.

6.2 By breaching this provision, Users would be committing a criminal offence under the Computer Misuse Act 1990. The Club will report any such breach to the relevant law enforcement authorities. In the event of such a breach, the User's right to use Our Website will cease immediately.

6.3 The Club will not be liable for any loss or damage caused by any denial-of-service attack, viruses or other technologically harmful material that may infect the User's computer equipment, computer programs, data or other proprietary material due to their use of Our Website or to their downloading of any material posted on it, or on any website linked to it.


7 Linking to Our Website

7.1 Users may link to Our Website provided they do so in a way that is fair and legal and does not damage or take advantage of the reputation of The Club, but they must not establish a link in such a way as to suggest any form of association, approval or endorsement on the part of The Club where none exists.

7.2 Users must not establish a link from any website that they do not own.

7.3 Our Website must not be framed on any other website. The Club reserves the right to withdraw linking permission without notice. The website from which Users are linking must comply in all respects with the content standards set out in our Terms of Use ('Clause 5: Content Standards").

7.4 If Users wish to make any use of material on Our Website other than as set out above they should contact The Club at its website.


8 Links from Our Website

8.1 Where Our Website contains links to other websites and resources provided by third parties, these links are provided for information only. The Club has no control over the contents of those websites or resources and The Club accepts no responsibility for those websites or resources or for any loss or damage that may arise from their use by Users.

9.2 The Club asserts all its intellectual property rights in Our Website. All photographs, text, graphics and other content used in Our Website are Copyright © 2012 Warrington Town Supporters Club, except for any material provided by third parties in which case the originator retains the copyright. All rights reserved.

9.3 Users must not use any photographs, text, graphics or other content displayed in Our Website for commercial purposes without obtaining a licence to do so from The Club.

9.4 Save to the extent expressly permitted below, photographs, text, graphics and/or other content may not be reproduced or transmitted or made available on a network in whole or in part by Users without the prior consent of The Club.

9.5 Users may print off one copy and may download extracts of photographs, text, graphics and/or other content from Our Website for their personal use only, on condition that

9.5.1 illustrations, photographs, video or audio sequences or any graphics must not be used separately from any acClubing text;

9.5.2 the status of The Club (and that of any identified contributors) as the authors of material on Our Website must be acknowledged.

11 Jurisdiction and applicable law

11.1 These Terms of Use are governed by and shall be construed in accordance with the laws of England and Wales and Users irrevocably submit to the exclusive jurisdiction of the English Courts to settle any dispute that may arise.
